The Short Version: Use Gander to plan amazing trips. Be respectful. Don't do anything illegal. We provide AI-powered planning tools, but you're responsible for your travel decisions. We're here to help you plan, not to be your travel agent or insurance company.
1. Accepting These Terms
Welcome to Gander, your AI travel wingman! These Terms of Service ("Terms") explain how you can use Gander's websites, mobile apps, chat and voice assistants ("Gus the Goose"), and related services (collectively, the "Services").
By creating an account or using our service, you agree to these Terms. If you don't agree, please don't use Gander. We may update these terms occasionally, and we'll notify you by email or in-app if we make important changes.
2. What Gander Does
Gander helps you plan, personalize, and book travel through AI-powered chat and voice tools. We help you:
- Turn travel inspiration from social media into trip itineraries
- Get personalized destination recommendations powered by AI
- Chat with Gus the Goose to refine your trips
- View itineraries, offers, and suggestions based on verified travel data
- Book travel through our platform or licensed booking partners
How Bookings Work
Merchant of Record (MoR) Bookings: When Gander is listed as the seller, we process your payment through regulated payment processors (like Stripe or Adyen). You'll receive a confirmation email once finalized.
Agent of Record (AoR) Bookings: When we connect you to a partner (airline, hotel, tour operator), that partner is the seller. Their terms, refund, and cancellation policies apply.
Each booking flow clearly indicates who the seller is before checkout.
3. Eligibility & Your Account
Age Requirement
You must be at least 18 years old (or the age of majority in your province or country) to use Gander.
Creating an Account
- Provide accurate information when signing up
- Keep your password secure and don't share your account
- You're responsible for all activity on your account
Group Trips ("Flock")
If you're planning a group trip, you represent that all members have agreed to share their details and preferences with Gander.
Account Security
If you think someone accessed your account without permission, change your password immediately and let us know at contact@trygander.com
4. How to Use Gander Responsibly
You Can:
- Create as many trips as you want
- Share your trips with friends and travel companions
- Use our AI assistant to plan your adventures
- Export or delete your data anytime
You Can't:
- Use Gander for anything illegal or harmful
- Share inappropriate, offensive, or hateful content
- Try to hack, break, or abuse our service
- Scrape or copy large amounts of data from Gander
- Impersonate others or create fake accounts
- Use Gander to spam or harass people
- Resell or redistribute Gander's services
5. Social Media Content
When you provide links to TikTok, Instagram, or other social media videos:
- You should only use publicly available content
- Respect content creators' rights and terms of service
- We may extract information from these videos to create your itinerary
- We're not responsible for the accuracy or legality of third-party content
4. Booking & Payments
Pricing & Taxes
Prices displayed include taxes where required by law. All prices are shown in the currency indicated at checkout.
Payment Processing
For MoR bookings, payment is processed through regulated PSPs (Payment Service Providers) like Stripe or Adyen. Your payment information is handled securely and we never store your full card details.
Refunds & Cancellations
Refund and cancellation policies are displayed in each checkout flow. Refunds are subject to supplier rules and may take several business days to process depending on your bank and currency.
Chargebacks
If you believe there's an unauthorized charge, please contact us immediately. We'll cooperate with your card issuer to resolve disputes.
Deposits for Group Trips
When you pay a deposit for a group trip, it may be refundable or convertible to credit depending on the supplier's policy, which will be clearly shown before payment.
5. AI & Recommendations
Gander uses a hybrid of AI models and rule-based systems to suggest itineraries based on your preferences and verified travel data.
Important Disclaimers:
- AI suggestions are starting points, not guarantees
- Results may contain errors or omissions
- Always verify visa requirements, entry restrictions, and travel advisories independently
- Prices, availability, and venue details may change
- We're not responsible if AI recommendations turn out to be inaccurate
Sponsored Placements
We provide clear labeling of sponsored placements and explain the reasons behind recommendations. You acknowledge that travel decisions remain your responsibility.
6. Your Content and Data
What You Can Create
You may save posts, upload itineraries, write reviews, or create "MigrationPaths" (shared itinerary guides).
You Own Your Content
Your trips, itineraries, and personal information belong to you. By using Gander, you grant us a worldwide, royalty-free license to display, remix, and distribute that content within Gander to operate the Services.
Content Removal
You may delete your content anytime from your account settings. Gander reserves the right to remove content that violates laws or these Terms (e.g., unsafe, misleading, infringing, or illegal material).
Creator Disclosure Requirements
If you're a creator using MigrationPaths or sharing itineraries, you must disclose any paid or sponsored trips per FTC, ASA, or applicable advertising guidelines.
Anonymized Data
We may use anonymized, non-personal data (like "most popular destinations") to improve Gander and create aggregate statistics. This data can't be traced back to you and may be shared with suppliers only if you've consented.
7. Privacy & Your Travel Data
We respect your privacy and build a "Memory Spine" - your personal travel graph - to personalize future trips.
- Your data is primarily stored in Canada and may be processed in other countries per our Privacy Policy
- You can view, download, or delete your data anytime in Settings
- We never sell personal data
- Anonymized or aggregated insights may be shared with suppliers only with your consent

8. Travel Disclaimer
Please Read Carefully:
- Travel conditions change constantly - verify all information independently
- We provide recommendations "as is" without warranties of accuracy or fitness for a specific purpose
- We don't guarantee supplier performance, deal availability, or that recommendations are risk-free
- Always check official sources for visa requirements, travel advisories, and safety information
- We're not responsible for your travel experiences, bookings, or any issues during your trip
- Get appropriate travel insurance for your trips
- You're responsible for all travel decisions and arrangements
Where required, Gander holds or partners under appropriate Seller of Travel registrations for users in California, Florida, and Washington.
9. Pricing & Future Changes
Some Gander features may be free, while others involve booking fees or service charges. Current pricing is displayed clearly in the app.
If we introduce new paid features:
- We'll give you advance notice
- You can choose whether to use paid features
- Core planning features will remain accessible
10. Service Availability
We try to keep Gander running smoothly 24/7, but we can't guarantee:
- Gander will always be available without interruption
- All features will work perfectly all the time
- We won't need to do maintenance or updates
We may also modify, suspend, or discontinue features with reasonable notice.
11. Intellectual Property
Gander's design, code, logo, and features are owned by us and protected by copyright and trademark laws. You can use Gander, but you can't copy, modify, or redistribute our intellectual property.
12. Disclaimers & Warranties
Each party warrants it has authority to enter this Agreement.
To the maximum extent permitted by law:
- Gander provides Services "as is" without warranties of any kind (implied warranties of merchantability, fitness, or accuracy)
- We don't guarantee uplift, conversion, accuracy of prices, or that every recommendation is perfect
- Travel information changes constantly - we're not liable for outdated information
13. Limitation of Liability
To the fullest extent permitted by law:
- Gander is not liable for indirect, incidental, special, or consequential damages (lost profits, missed flights, travel mishaps, etc.)
- Our total liability for any claim shall not exceed the greater of (a) CAD $500 or (b) the amount you paid to Gander for the specific booking in question
- These limitations don't exclude rights that cannot legally be waived under applicable consumer protection laws
In plain English: We're building tools to help you plan amazing trips, but we can't be responsible if something goes wrong with your actual travel, supplier performance, or if the service has technical issues.
13. Third-Party Services
Gander uses third-party services (like Google for AI, Supabase for data storage). These services have their own terms and privacy policies. We're not responsible for how they operate.
14. Termination
You Can Leave Anytime
Delete your account whenever you want from your account settings. Your data will be removed as described in our Privacy Policy.
We Can Terminate Accounts
We may suspend or terminate accounts that violate these terms, engage in abusive behavior, or for legal reasons. We'll try to give you notice when possible.
15. Governing Law & Disputes
These Terms are governed by the laws of Ontario and Canada.
If we have a dispute, let's try to work it out by contacting us first at contact@trygander.com
If that doesn't resolve things, disputes will be resolved by arbitration in Toronto, Ontario, under the ADRIC (ADR Institute of Canada) rules, unless you're protected by mandatory local consumer rights allowing court access.
You may also contact the Office of the Privacy Commissioner of Canada for data-related concerns.
16. Changes to These Terms
We may update these terms from time to time. If we make significant changes, we'll notify you via email or through the app at least 30 days before they take effect. Continuing to use Gander after changes means you accept the new terms.
17. General Terms
- If any part of these terms isn't enforceable, the rest still applies
- Our failure to enforce any right doesn't waive that right
- You can't transfer your account or these terms to anyone else
- These terms are the complete agreement between us about Gander

Wingspan Enterprise Terms of Service
Master Agreement for Enterprise Services
Entity: Gander Technologies Inc. (Canada)
Location: Toronto, Ontario, Canada
Welcome to Wingspan - the data and analytics suite that powers Gander's enterprise products.
By accessing or using Wingspan Studio, Insights API, Audience Intelligence, or any related enterprise feature (collectively, the "Enterprise Services"), you agree to these Terms.
1. Structure of Agreement
This Master Agreement governs all enterprise use of Gander's Enterprise Services.
- Specific pilots, seats, or APIs are described in individual Statements of Work ("SOWs") or Orders referencing this Agreement
- If a conflict arises, the SOW controls for that specific project
- This Agreement sets the baseline terms for all enterprise relationships
2. Account & Access
- You must register for an enterprise account and maintain secure credentials
- Only authorized personnel may access Wingspan
- You're responsible for your users' compliance with these Terms
- Access controls and permissions are managed through your admin dashboard
3. License & Use Rights
Gander grants you a non-exclusive, non-transferable license to access Enterprise Services during the subscription term specified in your SOW.
What You Can Do:
- Use anonymized or aggregated insights internally for marketing, analytics, and product improvement
- Integrate Wingspan APIs with your internal systems
- Generate reports and dashboards for your organization
- Share insights with authorized team members
What You Cannot Do:
- Resell, sublicense, or redistribute Wingspan data without written consent
- Publicly publish Wingspan data or insights
- Attempt to reverse-engineer or deanonymize traveler data
- Use data in violation of privacy laws or regulations
4. Data & Privacy
Enterprise Services process pseudonymized, consented traveler intent data.
- All data is provided "as is" with provenance and match-rate metadata
- No personal identifiers (email, phone, passport) are shared without explicit consent
- You agree to handle any personal data in compliance with GDPR, PIPEDA, and applicable privacy laws
- Data Processing Addenda (DPAs) are available upon request and form part of this Agreement
Privacy Commitment: Wingspan respects traveler privacy. All data sharing follows consent-based frameworks and privacy-by-design principles.
5. Service Levels & Support
Unless otherwise stated in your SOW:
- Availability target: 99.5% uptime per calendar month
- Scheduled maintenance: Up to 2 hours per week with 24-hour notice
- Support response times:
- Standard issues: Within 1 business day
- Critical outages: Within 1 hour
- Support channels include email, dedicated Slack channel, and ticketing system
6. Fees & Payment
- Enterprise fees are invoiced as specified in your SOW or order form
- Payment is due within 30 days of invoice date
- Late payments accrue 1.5% interest per month (or the legal maximum)
- Taxes are additional unless valid exemption documentation is provided
- Fees are typically based on seats, API calls, or data volume as specified in your agreement
7. Confidentiality
Both parties agree to protect all non-public information shared during collaboration.
Confidential Information Includes:
- Data, reports, models, and business plans
- API specifications and integration details
- Pricing and commercial terms
- Product roadmaps and strategic information
Exclusions:
Information is not confidential if it:
- Is publicly available through no fault of the receiving party
- Was independently developed without reference to confidential information
- Was rightfully obtained from a third party without restriction
- Must be disclosed by law (with notice to the disclosing party when possible)
8. Intellectual Property
- Gander retains all rights to Wingspan's software, data structures, algorithms, and methodologies
- You retain ownership of your own data and creative assets uploaded to the platform
- Derived insights produced through Wingspan remain Gander IP but may be used internally by you for business purposes
- No transfer of ownership occurs unless explicitly stated in writing
9. Attribution & Measurement
- Gander provides transparent match-rate and attribution logs for all Insights or API feeds
- You must not alter or obscure provenance metadata
- You must not attempt to deanonymize or re-identify travelers
- Audits may be conducted with reasonable notice to verify compliance
10. Warranties & Disclaimers
Each party warrants it has authority to enter this Agreement and will comply with applicable laws.
Gander provides Enterprise Services "as is" and disclaims all implied warranties including:
- Merchantability and fitness for a particular purpose
- Accuracy of data or predictions
- Guaranteed uplift, conversion, or attribution accuracy beyond published match-rate thresholds
11. Indemnity
Each party will indemnify the other against third-party claims arising from:
- Gross negligence or willful misconduct
- IP infringement directly attributable to that party's materials
- Material breach of these Terms
- Violation of applicable laws or regulations
12. Limitation of Liability
To the fullest extent permitted by law:
- Neither party is liable for indirect, consequential, special, or punitive damages
- Gander's total liability in any 12-month period is capped at the fees paid by you in that period
- These limits do not apply to:
- Confidentiality breaches
- IP infringement indemnities
- Gross negligence or willful misconduct
13. Term & Termination
Term
This Agreement begins on your first access to Enterprise Services and continues until terminated.
Termination Rights
- For convenience: Either party may terminate with 30 days' written notice after the initial term
- For breach: Either party may terminate immediately if the other materially breaches and fails to cure within 15 days
- For insolvency: Either party may terminate if the other becomes insolvent or files for bankruptcy
Effect of Termination
- Access to Enterprise Services ends immediately
- All outstanding fees become due within 30 days
- Confidentiality obligations survive for 3 years
- You must return or destroy all Wingspan data and materials
Surviving Provisions
The following sections survive termination:
- Confidentiality (Section 7)
- Intellectual Property (Section 8)
- Limitation of Liability (Section 12)
- Governing Law & Disputes (Section 14)
- Payment obligations for services rendered
14. Governing Law & Dispute Resolution
This Agreement is governed by the laws of Ontario and Canadian federal law.
Dispute Resolution Process
- Negotiation: Parties will first attempt to resolve disputes through good-faith negotiation
- Arbitration: Unresolved disputes will be settled by confidential arbitration in Toronto, Ontario, under ADRIC (ADR Institute of Canada) rules
- Costs: Each party bears its own costs unless the arbitrator awards otherwise
- Injunctive Relief: Either party may seek injunctive relief in court for IP or confidentiality breaches
15. General Terms
Entire Agreement
This Agreement, together with any SOWs and orders, constitutes the entire agreement between the parties regarding Enterprise Services and supersedes all prior discussions or agreements.
Amendments
Amendments must be in writing and signed by authorized representatives of both parties. SOWs may be executed electronically.
Assignment
You may not assign this Agreement without Gander's written consent. Gander may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control (acts of God, natural disasters, war, terrorism, government actions, pandemics, internet outages).
Severability
If any provision is found unenforceable, the remainder of the Agreement continues in full effect.
Waiver
Failure to enforce any right doesn't waive that right. Waivers must be in writing to be effective.
Notices
Legal notices must be sent via email with delivery confirmation or certified mail to the addresses specified in your SOW or to the contact below.
